We are happy to deliver some amazing news for H-4, E, and L dependent spouses! On November 12, 2021, following a settlement agreement known as Shergill v. Mayorkas, the United States Citizenship, and Immigration Services (USCIS) issued a new Policy Memorandum (Policy Alert PA-2021-25) outlining that the agency will automatically allow for employment authorization for dependent E, L, and certain H-4 spouses of principal visa holders, without requiring spouses to file I-765 application for employment authorization to be eligible to work in the United States.

The new Policy Memorandum also rescinds the agency’s previous 2002 Memorandum which did not allow dependent spouses in E, L and certain H-4 visa holders to automatically qualify for work authorization in the United States.

Following this new settlement, E, L, and certain H-4 spouses will be able to work just by having their valid visas, and they will not need to file any separate applications nor need an employment authorization card (work permit) to lawfully work in the United States.

While some doubt initially arose regarding whether E dependent spouses would qualify for automatic employment authorization, USCIS has now explicitly confirmed that it will indeed consider E and L dependent spouses to be employment authorized incident to their valid E or L nonimmigrant status.

The new November 12, 2021, Policy Memorandum outlines the following:

  • Certain H-4, E, or L dependent spouses to qualify for an automatic extension of their existing employment authorization and accompanying employment authorization document (EAD) if they properly filed an application to renew their H-4, E or L-based EAD before the document expires and they have an unexpired Form I-94 evidencing their status as an H-4, E, or L nonimmigrant;
  • The automatic extension of the EAD will continue until the earlier of: end date on Form I-94 evidencing valid status the approval or denial of the EAD renewal application, or 180 days from the date of expiration of the prior EAD document; Form I-94, evidencing unexpired nonimmigrant status (H-4, E or L), Form I797C receipt for a timely – filed EAD renewal application stating “Class requested as “(a)(17),” “(a)(18) or ((c)(26)”, and the facially expired EAD issued under the same category);

Welcome back to Visalawyerblog! In this blog post, we will cover the release of the December Visa Bulletin 2021 and what you can expect for employment based and family preference categories during the month of December 2021.

The Department of State releases the visa bulletin on a monthly basis, which summarizes the availability of immigrant visa numbers for that particular month. The “Final Action Dates” and “Dates for Filing Applications,” charts indicate when immigrant visa applicants should be notified to assemble and submit the required documentation to the National Visa Center.


Adjustment of Status Filings for those lawfully residing in the United States


In general, if USCIS determines there are more immigrant visas available for a fiscal year than there are known applicants for such visas, the agency will provide instructions on the www.uscis.gov/visabulletininfo webpage that applicants may use the Dates for Filing chart. Otherwise, USCIS will indicate that applicants must use the Final Action Dates chart to determine when they may file their adjustment of status application with USCIS. If a particular immigrant visa category is “current” on the Final Action Dates chart or the cutoff date on the Final Action Dates chart is later than the date on the Dates for Filing chart, applicants in that immigrant visa category may file using the Final Action Dates chart during that month.

In this blog post we share amazing news with our readers regarding the settlement of a recent class-action lawsuit filed against the U.S. Department of Homeland Security. The agreement reached under the settlement will immediately allow for automatic renewals of employment authorization for: L-2 spouses of L-1 nonimmigrants and qualifying H-4 dependent spouses who (a) properly file an application to renew their H-4 based employment authorization document before expiration (b) have an unexpired Form I-94 showing their status as an H-4 nonimmigrant and (c) who will continue to have H-4 status beyond the expiration date of their employment authorization document. Shergill v. Mayorkas, No. 21-1296 (W.D. Wash.)


What does this new settlement mean?


 Effective immediately, the Shergill settlement will make it a lot easier for L-2 and H-4 dependent spouses to continue working in the United States without having to apply for a renewal of their employment authorization and without interruptions to their employment. As many are already aware, the processing of I-765 employment authorization applications is currently subject to extreme delays due to the pandemic and burdens on USCIS offices. This new settlement will prevent L-2 and certain H-4 dependent spouses from being stuck in these backlogs. Not to mention L-2 and certain H-4 spouses will no longer have to pay the required $410 filing fee to renew their employment authorization. Following this new settlement, L-2 spouses and certain H-4 spouses will be able to work just by having their valid H-4 and L-2 visas, and they will not need to file any separate applications nor need an employment authorization card (work permit) to work in the United States.


Guidelines for Dependent Spouses under the Settlement Agreement


Under the terms of the Shergill settlement agreement, as it relates to L-2 dependent spouses, USCIS will now interpret 8 CFR § 274a.13(d) to recognize that employment authorization for such spouses is now linked (incident) to their visa status. USCIS will also allow up to 180-day automatic employment authorization extensions when the applicant has already had the H-4 or L-2 status extension granted either through USCIS or through travel.

Automatic Renewals of Employment Authorization for applications that already have valid H-4 status

  • Pursuant to the settlement agreement, USCIS is now interpreting the law so that H-4 nonimmigrants who have timely filed their I-765 EAD renewal applications and continue to have H-4 status beyond the expiration date of their EAD, qualify for the automatic extension based on their (c)(26) EAD.
  • This automatic extension will terminate on the earlier of: the end date of the H-4 status, adjudication of the EAD renewal application, or 180 days from the previous card’s expiration date.

Welcome back to Visalawyerblog! In this blog post we share with you some recent news regarding a new class action lawsuit that has been filed by 49 plaintiffs against the Department of Homeland Security (DHS) and United States Citizenship and Immigration Services (USCIS), seeking relief from the extreme processing delays currently taking place for I-765 applications for employment authorization (EADs) filed by individuals seeking adjustment of status (AOS) in the United States, and for I-765 applications filed by E-2 dependent spouses with USCIS.

Currently, USCIS reports that I-765 work permit applications based on a pending I-485 adjustment of status application are taking between 20 to 21.5 months to process at the California Service Center; while it is taking 9 to 9.5 months to process work permit applications at the National Benefits Center; and 9.5 to 10.5 months to process such applications at the Nebraska Service Center.

The new legal challenge against the government has been mounted by the American Immigration Lawyers Association (AILA), Wolfsdorf Rosenthal LLP, Joseph and Hall PC, Kuck Baxter Immigration LLC, and Siskind Susser PC.

The lawsuit seeks to hold the government accountable once and for all for the exorbitant processing times taking place for work permit applications to be adjudicated, especially those at the California Service Center. Under the law, applicants for adjustment of status are afforded the option of applying for temporary employment authorization while their green card applications are pending with USCIS, through what is supposed to be an easy procedure that involves filing a simple I-765 application for employment authorization. In normal circumstances, such employment authorization applications took on average 7 to 9 months to be adjudicated. Since the onset of the pandemic however USCIS has not been able to adjudicate these applications within reasonable timeframes.

Processing times have gotten worse and worse to the point that applicants are receiving their green card interview appointments before even coming close to receiving an approved employment authorization document. This has resulted in applicants being unable to seek employment while waiting for their green card applications to process. This has caused great cause for concern for individuals who have a job offer lined up or who need to work to maintain their households. Further, the American economy is experiencing more and more labor shortages as they struggle to get individuals back to work. The situation at the USCIS level is making it even more difficult for American businesses to find qualified workers.

U.S. Welcomes International Air Travel from Fully Vaccinated Starting Monday November 8th


As we have reported on our blog, the Biden administration has issued a new Presidential Proclamation that rescinds the geographic COVID-19 related travel restrictions for fully vaccinated international air travelers to the United States. The new Proclamation will go into effect at 12:01 a.m. Eastern Standard Time on Monday, November 8, 2021. Travelers will need to be prepared to provide documentary evidence of full vaccination against COVID-19 (both doses are required for the Pfizer and Moderna vaccines) as well as proof of a negative COVID-19 test within 3 days of boarding. Certain narrow exceptions to the vaccine requirement have been made in the Presidential Proclamation, however it is important to note that even those who fall under an exception must become fully vaccinated against COVID-19 within 60 days of entry to the United States unless any of the following apply.

  • the noncitizen’s intended stay is sufficiently brief, as determined by the Director of the CDC;
  • the noncitizen is one for whom, given their age, requiring vaccination would be inappropriate, as determined by the Director of the CDC;
  • the noncitizen has participated or is participating in certain clinical trials for COVID-19 vaccination, as determined by the Director of the CDC;
  • COVID-19 vaccination is medically contraindicated for the noncitizen, as determined by the Director of the CDC;
  • the noncitizen is described in section 3(b)(i) or 3(b)(ii) of this proclamation and has previously received a COVID-19 vaccine that is authorized or approved by the noncitizen’s country of nationality, as determined by the Director of the CDC, in consultation with the Secretary of State; or
  • the Director of the CDC otherwise determines that COVID-19 vaccination is not warranted for the noncitizen.

U.S. will also open the land border to fully vaccinated non-essential travelers from Canada and Mexico starting November 8


In similar fashion, also on Monday, November 8, 2021, the United States will be opening its land border and ferry ports of entry to fully vaccinated nonessential travelers from Canada and Mexico. Travelers will be required to have appropriate paperwork that provides proof of vaccination. The entry of individuals who have not been fully vaccinated for COVID-19 will continue to be restricted for non-essential travelers.

A new House reconciliation bill adds new language that could open a path to permanent residency for highly skilled immigrants without waiting for their priority date to become current.

The new bill, known as H.R. 5376 “the Build Back Better Act,” is the latest initiative backed by the Biden administration to strengthen the middle class and enhance economic ingenuity.  Interestingly, the bill provides a framework that would improve and reform our immigration system with particular benefits for highly skilled immigrants.

If passed section 60003 of the reconciliation bill would exempt an alien (and the spouse and children of such alien) from the numerical limitations described in the employment-based immigration section of the Immigration and Nationality Act, and allow the alien and any follow-to-join dependents to adjust their status to permanent residence provided such alien submits or has submitted an application for adjustment of status and . . . is the beneficiary of an approved petition . . . that bears a priority date that is more than 2 years before the date the alien requests a waiver of the numerical limitations; and pays a supplemental fee of $5,000.” (Emphasis added.)

If passed these legislative measures would be extremely beneficial to highly skilled workers because it would allow employees in the visa backlogs to file for adjustment of status without waiting for a priority date to become available. Following this proposal, once a labor certification application would be approved by the Department of Labor, an employee could be eligible to file his or her I-485 adjustment of status application concurrently with his or her I-140 petition for alien worker and apply for temporary work authorization while the applications would remain pending with USCIS.

The House reconciliation bill would also allow family-based immigrants inside the United States to gain permanent residence outside the numerical limits if their priority date is “more than 2 years before” and the individual pays a $2,500 supplement fee. EB-5 category (immigrant investor) applicants would need to pony up a $50,000 supplement fee. The provisions to pay a supplemental fee to receive a green card outside the numerical limits would expire on September 30, 2031.

Happy Monday! Welcome back to Visalawyerblog. We start the week with the highly anticipated White House release of “Proclamation on Advancing the Safe Resumption of Global Travel During the COVID-19 Pandemic,” which rescinds the various COVID-19 related geographic travel bans previously in place for travelers from certain geographic regions with high rates of COVID-19, for those who have been fully vaccinated for Coronavirus at 12:01 a.m. eastern standard time on November 8, 2021. The Proclamation also carves out numerous exceptions for those found “exempt” from the vaccination requirement.


Highlights of the New Proclamation


President Biden has released this new proclamation and moved away from the country-by-country restrictions that previously applied during the pandemic in favor of an air travel policy that relies on vaccination to advance the safe resumption of international air travel to the United States.


Who does this new Proclamation apply to?


The new proclamation applies to the entry into the United States of all noncitizen nonimmigrants (noncitizens who are visiting the United States or otherwise being admitted temporarily) traveling to the United States by air.

The proclamation suspends the entry of unvaccinated noncitizen nonimmigrants, except in limited circumstances, –the exemptions to the vaccine requirement– and it ensures that the entry of unvaccinated noncitizen nonimmigrants is consistent with applicable health and safety determinations made by the Director of the CDC, including a requirement that, where appropriate, such individuals agree and arrange to become fully vaccinated against COVID-19 upon their arrival.

Welcome back to Visalawyerblog! We have very exciting news regarding the Biden administration’s plans to rescind the Covid-19 related travel bans that have suspended and restricted entry into the United States, of immigrants and nonimmigrants, physically present within the Schengen Area, Brazil, China, India, the United Kingdom, Ireland, South Africa, and Iran since 2020.

On October 15, 2021, the White House announced that the United States will allow international travelers who are fully vaccinated against Covid-19 to enter the United States by land or air starting November 8, 2021.

This decision will lift the ban for vaccinated visitors from the affected regions.

On Friday October 15, 2021, a White House Official stated that the “CDC has already informed airlines that all FDA approved and authorized vaccines, as well as all vaccines that have an Emergency Use Listing (EUL) from the World Health Organization (WHO) will be accepted for air travel. We anticipate the same will be true at the land border. These travelers are required to be prepared to attest to vaccination status and to present proof of vaccination to a CBP officer upon request. By January, foreign nationals traveling across the land border for both essential and non-essential reasons will be required to be fully vaccinated.”

While the White House is still ironing out the complete details of the new policy including what exemptions the Biden administrations will grant to the vaccine requirements, we know that only generally applicants who are fully vaccinated against Covid-19 will be allowed to enter.

The CDC considers an individual to be fully vaccinated against COVID-19:

  • 2 weeks after their second dose in a 2-dose series, such as the Pfizer-BioNTech or Moderna vaccines, or
  • 2 weeks after a single-dose vaccine, such as Johnson & Johnson’s Janssen vaccine

COVID-19 vaccines currently approved or authorized for emergency use by the U.S. Food and Drug Administration include Pfizer-BioNTech, Moderna, and Johnson & Johnson COVID-19 vaccines, while COVID-19 vaccines authorized for use by the World Health Organization include AstraZeneca/Oxford, Covishield, Sinopharm, and Sinovac.

Happy Columbus Day! In this blog post, we share important updates regarding the Diversity Visa Lottery Program for fiscal year 2023.


What you need to know


The State Department is now accepting online registrations for the Diversity Visa Lottery program for Fiscal Year (FY) 2023 (registration opened Wednesday, October 6, 2021, at noon EDT).

Foreign nationals who want to have a chance of being selected must register for the lottery by Tuesday, November 9, 2021, at noon EST online.

The Fiscal Year 2023 DV lottery program will have up to 55,000 green cards up for grabs that will be selected through a randomized computer-generated process. Winners for FY 2023 are expected to be announced in May 8, 2022.


Why should I apply?


Foreign nationals selected in the FY 2023 lottery are eligible to file their green card applications starting on October 1, 2022.


Am I eligible to enter?


You are eligible to participate if you meet the following requirements.

Requirement #1: You must be a native of a country with historically low rates of immigration to the United States to enter

If you are not a native of a country with historically low rates of immigration to the United States, there are two other ways you might be able to qualify.

  • Is your spouse a native of a country with historically low rates of immigration to the United States? If yes, you can claim your spouse’s country of birth – provided that you and your spouse are named on the selected entry, are found eligible and issued diversity visas, and enter the United States at the same time.
  • Are you a native of a country that does not have historically low rates of immigration to the United States, but in which neither of your parents was born or legally resident at the time of your birth? If yes, you may claim the country of birth of one of your parents if it is a country whose natives are eligible for the DV-2023 program.

In this blog post, we share with you some exciting new updates in immigration for Croatia and Syria.

We are very happy to announce that Croatia has now joined the Visa Waiver Program. The Visa Waiver Program allows foreign nationals of participating countries to travel to the United States for purposes of tourism or business without having to obtain a U.S. visa. Such stays are limited to 90 days or less, and all travelers must have a valid and approved Electronic System for Travel Authorization (ESTA) prior to traveling to the United States.

Visa Waiver participants are not eligible to change or extend their status within the United States during those 90 days. Only applicants who enter on a U.S. visa may apply for a change or extension of status with USCIS. It is also important to note, that applicants who have been denied a U.S. visa in the past are ineligible for ESTA.


When can Croatian nationals travel under the Visa Waiver Program?


The Secretary of Homeland Security Alejandro Mayorkas, and Secretary of State Antony Blinken designated Croatia as a new participant in the program, that is set to start no later than December 1, 2021. The agencies announced that the ESTA interface will soon be updated to allow Croatian nationals to apply for ESTA prior to travel to the United States. Applicants should note that ESTA authorizations are generally valid for two years.  Those with valid B1/B2 visas are recommended to continue to use their visas for travel to the United States.

Following the announcement, Secretary Mayorkas said that the designation of Croatia as a new participant in the Visa Waiver Program is an important recognition of U.S./Croatian shared economic and security interests.

With this new announcement, Croatia becomes the 40th member of the Visa Waiver Program found eligible to participate after having met strict requirements.

TPS for Syria EADs Automatically Extended through March 28, 2022


We would also like to announce some important information for Temporary Protected Status beneficiaries from Syria. The U.S. Department of Homeland Security has automatically extended the validity of Employment Authorization Documents (EADs) for beneficiaries with a Category Code of A12 or C19 issued under Temporary Protected Status (TPS) for Syria through March 28, 2022.
