BREAKING: USCIS Announces Second Lottery for Regular Cap Will Be Made from Previously Submitted FY 2025 H-1B Cap Registrations

Today July 30, 2024, the U.S. Citizenship and Immigration Services (USCIS) announced that it will be conducting a second lottery to select additional beneficiaries for the H-1B Fiscal Year 2025 cap season to reach the regular cap numerical limit.

USCIS will be drawing from previously submitted electronic registrations from FY 2025 to choose beneficiaries at random. Our readers will recall that the initial registration period for the H-1B FY 2025 cap season ran from April 1st to June 30th and the first lottery was conducted back in March.

The second round of selection for the regular cap will include previously submitted registrations that indicated eligibility for the master’s cap, along with those that indicated only eligibility for the regular cap.

Once the second lottery has been completed, petitioners with selected registrations will be notified via their myUSCIS organizational accounts online, that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration.


What to do now


Petitioners should keep a close eye on their myUSCIS online accounts in the coming days and weeks to review the status of previously submitted registrations. Those who are selected will receive selection notices, including details of when to file their petitions with USCIS.
